Are we being lied too

What is the name of your state (only U.S. law)? South Carolina
My husband had a car accident last in September. He was hit in the rear,the car was total.He was hit by a uninsured 16 years old driver. Our insurance only payed the lienholder of our car. Our lawyer said that the only way we can get any money is by suing the driver in Civil court. Is this true.This was our only car and the accident has cost us to lost out on jobs.I can not buy another car because we were upside with this car.Now we have no car but I owe 8,000 dollars on the car. What can we do

The only money you MIGHT be able to get from the other driver is your deductible. Your loan is irrelevent to the accident. You should have had Gap insurance.

Lawsuits are not about justice. They are about MONEY. If you don't want money, then you shouldn't be thinking about suing. And people post here because they are thinking about suing. Because they want money, no matter how much they don't want to admit that to themselves.
