What am I entitled to?


What is the name of your state? TX
Hello,
My sister was driving my car and sitting at a red light when a drunk driver hit her head on. Thankfully she sustained no serious injuries, but my car was totaled. The driver was arrested and is in jail b/c this was his second offense. My question is what kind of damages am I entitled to? The driver was not the owner of the truck and I am having a hard time w/ the owner's insurance company. I am unsure if the driver had insurance b/c the cop didn't get it. Am I entitled to more than just the value of my car? Specifically, can I sue the driver for neglagence or attempted manslaughter since he intentionally got behind the wheel? If he has no assets, then who can I sue that does? I have been very inconvenienced by this and I am nervous when I drive now b/c I have a 2 year old. After seeing the damages of the car, I feel like the repeat drunk driver owes my family the safest car on the markwt to protect us from harmful people like hinself. Is that possible? Also, if he was leaving a bar can I sue them and what are my limits?
