| | | well my rule no. 1 is to get a lawyer from the get go.
here are a few others:
1. don't provide a recorded or written statement to the auto insurance claims representative until you have had a lawyer's consultation
2. get yourself a notebook now to write in every time you have a contact with the insurance claims representative - whether it be by phone, fax, or email - and write specifics as date, time, who made the contact (you or rep), and what was the nature of the communcation.
3. in your notebook, make a separate section for anything you may feel that is out of the ordinary for you. this includes physical, mental, or emotional pain. write down specifics along with date, time, and symptoms.
4. keep track of any expenses you may have as you will need to pay for them upfront first and then seek reimbursement when you are done seeking treatment.
5. find out what the statute of limitations is in your state and/or jurisdiction. if necessary, let that be your guide to help determine if you are completely recovered from any injuries sustained from the accident.
6. until you are absolutely sure that you have recovered from any injuries of the accident, don't sign any settlement offers. once you get to this phase, you may want to take all your collected information with you and review it with an accident lawyer.
7. keep a copy of all medical notes filed that you have provided access to the insurance adjuster.
8. do not sign any authorizations to access medical records from any providers until you have consulted with an attorney.

depending on the type and seriousness of accident you were involved in, you may need to seek the assistance of an attorney at different steps of the way.

however, i also believe that some points i wrote down, from my very own recent experience, are not misguided but actions that would help protect all of his/her best interests.
if you think anything was misguided, that is your opinion and you are entitled to it. |

| | | OP clearly said he does NOT want to use a lawyer, maybe he doesn't want to sue his friend. And KY is a no-fault state, so his own car insurance, or that of someone in his household, will pay for his medical bills. Telling someone not to cooperate with an accident investigation is bad advice. No one is ever going to try to place a passenger at fault for anything.

i almost get the feeling you are an insurance adjuster rather than someone who is on the side of the regular joe. |
