what if no police involved?


What is the name of your state (only U.S. law)? Wisconsin
If someone is in a car accident, and they don't want to call the police, but they say it's the other person's fault, what rights do they have in regards to getting payment for damages? Both cars are damaged, neither has insurance, and there is no police reportWhat is the name of your state (only U.S. law)?

When I read your title I wondered why wouldn't you want the police called to document the accident ~ well, now I know the answer.

Since neither of you have insurance, you have no one to speak on your behalf and are afforded no protections. You may say that the other driver is at fault, the other driver may say that you are at fault.

Fix your own car and hope the other driver doesn't come after you. The other driver is probably doing the same.

There may be clear liability on one driver or the other. That's what small claims court is for. They are morons for not having insurance. And the DMV will most likely find out about the accident and the lack of insurance and will suspend both licenses for 1 year.
