| What are my options? My car was hit outside my house, by a hit and run driver. They hit the drivers side door going 60 m.p.h in a 25 m.p.h zone. The car was hit from the street to the side walk, ramming it up and over the curb. The driver was never caught, but my insurance covered it under uninsured motorist. My questions are as follows:

1.) I got the car fixed at a body shop, but since it was a 93 Del-Sol the parts they repaired and painted do not match the rest of the car. It looks aweful, and most likely will lower the value of my car now. Do I have to take it like it is? Is there anything that can be done? Do they atleast have to buff the other paint out to make it look close, or paint it, what are they required to do?
2.) When I got the car back the Check Engine light was on and the muffler and exhuast were making god aweful noises. The car was in good shape before the wreck. The next day the muffler fell off and the brakes by the muffler began making noise. I called the insurance company and they said to take it somewhere and have it looked at. They said most of the stuff is probably a pre-exsisting problem. When the garage I took it to looked at it, they said the 9-10 things they found ($1700) worth of damage was most likely caused by the accident. The insurance company is claiming they were not done by the accident, what are my options?
3.) There were numerous things wrong with it when I got it back, but the first place I took it to, was basically the "insurance's" body shop. They told me they would evualate the whole car, because I didn't want something unsafe back.
When I got the car it had all these problems and the mechanic/body shop owner told me that they didn't even check the engine or the rear of the car, because they did not have to, because they assumed it wasn't related to the accident. They said that if they had looked at it, the insurance company wouldn't have covered it. Is this true?
Now the insurance company is saying that since I had to take it to this 2nd place and they (the insurance company) said it wasn't accident related, that I have to foot the bill for them even looking at it. Shouldn't it have been looked at all along? Why doesn't the insurance company make there body-shop look at the car to make sure it's not unsafe before I get it back? Are they required to do that or not?
Any information or advice you can give me on this would greatly help. I'm 20 years old and I'm going to be attending college next month, I don't have the money to fork out to pay for this. Is my insurance company just playing hard-ball, or am I really as screwed as they're saying I am? Thanks in advance. |
