What Payment Option am I given?


What is the name of your state? (Accident in Kentucky) (Residence in Tennessee)

About 2 months ago while driving in KY I had a front (Front, R-side) minor collision with other driver (Front, R-side).
It was my very the first accident ever in my driving life of 35 years.
It could not occur any worse than that time: I had lost my voice and could not fully explain to the police officer, my auto insurance had been expired, and the police determined my fault after mostly listening to other party and her teenage friends. In my opinion, both parties were equally at fault but because of my expired insurance, an officer told me not to speak out.

No bodily injury. Both vehicles sustained a partially cracked front-side bumper and one turning light case broken for me (light & case for her). Immeditely after the accident I inspected & spotted that the young driver's car had scratches and a vertical hole on the other (Left) side of the bumper (obviously this accident could not cause them) I stated to her that I would not pay for those pre-existing damages. But then I heard her driver's teenage occupant telling her that I should pay her (at this momemt I thought that she could make me pay for pre-existing damages)

When her insurance company in Macon, GA (GEICO) sent me a payment method selection paper, I selected "other option" and requested it to have her get two or three estimates with at least one photo of the damaged section. I also noted that I would be immediately paying once estimates have been received.

Instead of getting estimates that I had requested, they just let time go away for more than one month. Suddenly, her insurance company (Macon, GA) had a credit collection agency in Newton, MA to issue a FORMAL SUBROGATION NOTICE on 5/9/06 and send it out from Marietta, GA on 5/16/06 (stamp marked). It arrived at my residence on 5/18/06.

{The NOTICE reads: This notice was determined by our client. . . . "once full payment has been posted to your account, and clears a 14-day hold, you may access to our payment web site www.ccspayment.com}

They did not mail it out until 7 days after it was issued!
Q1: What option do I have here?

Both veicles involved are relatively simliar in size, sales price when new and level of damage but the amount estimated by GEICO shown on the NOTICE is way too higher and over three times as high as the cost to fix a similar damage. But because a fault was determined on my side, I feel beaten and need your advice.

Q2: Do I have the right, bt the Law, to act my own insurance company so that I can negotiate on a eqaul base with GEICO which my insurance company would do had my insurance still valid?

Q3: I have money to pay. I want to continue directly dealing with GEICO and not the collection agency (CCS). Am I given an option at this point?


Q4: If your answer is "no," I am willing to make a partial payment right away.

Q5: Do I have the right to refuse to make a payment for remaining balance unless they show me REPAIR COST RECEIPTS?
