whats the law re unlicensed drivers

What is the name of your state? CALIFORNIA

Please please please answer these questions and please, if you want to be sarcastic (we saw other posts) do not reply to this post, we are looking for good and worthy replies. Thank you.
My family member under 18 has caused an accident - rear ender, its his fault.

Here are the issues:
1. Driver of rear-ended car was unlicensed, did not want to provide address to CHP, probably illegal alien, CHP impounded his car and left him to be picked up by the side of freeway
2. Registered owner is hard to find - European, someone told us reg owner sold car to them, and still did not tranfer ownership, also that he is out of town and that he d be hard to reach till after the weekend.
3. We have no info on who is reg owner and whos is on the insurance as the driver could speak no English, CHP told us to PU cover page of report after weekend for contact info.
4. Got a message from the supposed reg owner (European - with Mexican accent asking for us to call, in the background another person was giving this reg owner a phone number to call. The number in the message left did not pan out and did not match the number seen on our caller ID. Now would the reg owner not know his own phone number?

Here are our questions:

In regards to damages:

1. Is our insurance required to cover damages if the other driver was unlicensed?
2. If so is there a limit on damages if the other driver was unlicensed?
3. We do not believe that the European reg owner is going to show up, what can we ask for in re ID from the reg owner if he actually exists and is in this country?
After all would he not want to transfer the car out of his name and into the new owners name ASAP to limit liability? Its all very, very, very fishy.

A: Fault has nothing to do with licensing; ask your agent if you have uninsured motorist coverage AND ask your other questions of your agent also.
