| | | when does your policy legally go in effect? What is the name of your state? TEXAS
If a represenative from an insurance company states that you are covered over the phone for comprehensive coverage are you legally covered in the case of an accident? what if they bait you into the office to fill out paperwork after an accident occurs, because they knew about it and are persuing insurance fraud charges after they knew the accident happened and said that the policy was not valid unless I signed the agreement after taking bank eft information.

| | | I would think the moment you sign up for insurance you're covered. I know with progressive you can just print out your insurance cards while you wait for the other ones in the mail. |

Had you paid for the insurance over the phone when the representation was made?

| | | I gave my insurance guy a routing number for a eft transfer, from my bank and he stated that I was covered as of 5:13 that day. he stated that he had the agreement and I needed to sign it and fax him back a copy of a voided check, that progressive likes to have a copy in their file. buti did not receive the fax and i thought i had coverage and i totalled my bike 9 days later to the tune of 12k. progressive stated they knew i was at a particular hospital at the date I was there, they must have used my ss number.Although i did not sign a release is that not a violation of my civil rights of the privacy act?

post again and this time try and make some sense. what does the hospital have to do with anything?

I consulted an attorney about what I should do for this situation and he said "what are you waiting for, go sign the agreement then report the claim" then made a joke about geico insurance so I gave him 100.00 and walked out.The insurance company violated my civil rights under the privacy act to obtain information about my claim without me sighning a medical disclosure, I went to the police station and walked out with the original police report the day after the accident yet the insurance company had a copy. Do they scan accident reports and then file them? I received a call from the insurance company wanting me to sign a medical release. I then called the same attorney and told him what they were asking of me. he said not to sign it and that what i did is not what he said to do. Then the insurance company called and said they wanted to finish up my claim and that i needed to come up there.When I went up to my insurance company they had a folder with ayellow sticky note with the same attorney's name that I paid then took it off and stuck it inbetween some papers. and asked me an hours worth of questions then showed me a copy of the police report and stated they knew what date the accident happend and what hospital I had a friend drive me to later that night, after I was finally able to get my motorcycle towed to my house. The last thing they said was dont expect them to pay for the claim since I wasnt coved the date of the accident which was 9 days after I was told I was covered over the phone with the same company that my 3 other cars are covered through with the same agent. I consulted my brother in law who specializes in family law/divorce and he told me I need some good advice from someone that is not arleady in the insurance companys pocket.

You didn't sign the agreement and send it back so you're not covered.
What am I missing?
