who is liable?

My car was parked in my company parking lot, a tree fell down and hit my car. I experienced difficulties to find out who should be repsonsible for it. The land lord's insurance did not want to pay, they said it's windstorm, the tree was ok if there's no windstorm.

My question is: if a lawyer handle this case, what will he/she do? How much will he/she charge for this case.

My state is CA.
