I was in a car accident in april of last year. I was rear ended by a lady who was not paying attention. I did not have insurance nor did she. My car was totaled and she has refused to pay for the damages and I had to get a rental car for about 1 week and she did not even help pay for that. Do I sue her and when is it to late?????
if the total damages are under your state's small claims limit, take her to small claims court. be prepared, tho. if you enter the legal system to resolve this and your state has penalties for driving without insurance, those penalties may be imposed.
Yes and it states clearly that she was at fault and neither one of us got cited for the no insurance I do have insurance now with uninsured motorist coverage- the total is over small claims but I am willing to settle for the small claims amount to avoid attorneys cost
