Who's at fault? (rear-ended)


What is the name of your state?MN

I was rear-ended this week.
I called for a Police Officer to come to the scene to make a report.
I don't think the lady was to happy about that.
She just wanted to exchange info and be on her way, but anyway.
At the scene she said she didn't want to go thru the Ins Comp, but wanted me to get (3) estimates, and she would pay out of pocket.

That evening she called and talked to my Boy Friend Mike, and he told her we got one estimate from the place that would be fixing the car, and that we weren't going to get any other est.
He told her the total amount and they hung up.

(5) min later her Husband calls and tells Mike that his wife is not totally at fault but that I'm 10% at fault for just being there.
Mike told him well will just deal with the Ins Comp.

So what does that mean, Do they think we should take 10% off the repair bill?
"Ya Right"

So the plan then was to go thru the Insurance Comp.

I called my Ins Comp to find out what to do next.
They said it was not my fault and the Officer said the same thing.
Right know I'm waiting to get the Police Report, that takes a couple of day's.

Then she calls today, and tells me she changed her mind again and wants to pay out of pocket.
She wanted to know where I lived so that she could come to my house or meet me somewhere to take photos of the damage to the car.
She wants to know where the car is going to be fixed, so she can get whatever info she needs from them.
She goes on to tell me again that I'm at fault for just being there, and it's going to go on my record as well.

A friend said she Harassing me.
Any thoughts on what to do would be nice.

You are not at fault for just being there. That is a load of crap. She had a responsibility to watch where she was going and to have her vehicle under control at all times.

And let me add one more thing, invest in caller ID and don't take any more of their phone calls. Let the insurance company deal with their rantings.
