who's liable?


What is the name of your state? ohio

a friend of mine was in an accident while driving my car and totaled it. she was found guilty for it, but my insurance ended up paying my car off due to full coverage. i did, however, have to pay the deductable. on a legal standpoint, does she owe that money back to me, or did i basically get screwed over out of a nice car, and a $500 deductable?What is the name of your state?

Sue her in small claims court for the direct and actual amount of damages in the dollar amount she caused you.

You can sue to get the money back. She is liable. She was negligent. However, you didn't get "screwed". You allowed someone to drive your "nice car" knowing that accidents happen. That is what insurance is for.

thanks for the advice. sorry i used the word "screwed". i'm still just a little upset about the whole situation. but you're right. accidents do happen! but thanks again for the input!
