Junior Driver and Insurance Coverage?

What is the name of your state (only U.S. law)? I live in NY state. Does a junior driver have any insurance protection under his parents policy when driving alone at night without a licensed driver in the car. Does this junior drivers (parents) auto insurance company have any right to find the other party at all at fault if this junior driver is involved in an accident?

If the accident was the other guy's fault, then it was the other guy's fault, even if your kid wasn't supposed to be driving alone. And if he's listed on the policy, then he's a covered driver.
