What is the name of your state? State of Louisiana. I am trying to find out some information for my brother who has a WC claim for a back injury. It has been 7 week since the injury and he is still trying to get the necessary medical test done to see if he will need surgery. 6 years ago he hurt his back on a job (a different employer) and had to have back surgery. His doctor has advised him that this injury is not a re-injury but a new injury to his back. Workers comp has asked that he sign a medical release in order for them to obtain his old records from his first surgery. They told him that they could be reimbursed from the state due to a double disablity???? Not sure what that means, but he is concerned whether or not they have the legal right to those records from the prior injury and whether their intent is to use that against his current claim. Should he hire an attorney prior to signing this release?
