My husband has been working for the same fortune 500 company in California for 23 years and had to have knee replacement surgery this year at 41 years old. He filed for his work to be partially liable, do to the fact that all of his bosses knew his knees were bad and he was still required to go do on truck audits which involves getting in and out of delivery vans and following drivers around all day. He knees were injured in high school but the work environment sped up the deteriation by quite a bit. Also he requested transfer out of his current position in order to do a job that wouldn't riquire climbing stairs and ladders and had an open invitation to transfer but his boss would not let him transfer. This has happened several times in the last 10 years. The reason that we want the company to take partial, not complete, responsibility is due to the fact that he has tried to move out of the aggressive physical part of the company and hasn't been allowed to and there's a medical cap/limit that may max out if he has to have the other knee done, and because he had to have it done at such a young age he will have to have the replacement-replaced in 15-20 years. What we're worried about is that-as medical costs go up, we will reach our cap before retirement even gets here, which puts us out of medical insurance if he ever has any major medical expences. HELP!
