I asked this question severals days ago and have not gotten any reply. Please HELP if you can!!!!! I am rewriting it so you can reply to this post.

Recovery Amount on a Slip & Fall ?

According to my attorney I have a very good "slip & fall" case but he is not so enthusiastic about the recovery amount. I fell in our local mall parking lot due to some type of water drain not having its lid on and leaves were built up in it where you could not see the hole at all. When I fell I had a couple of minor injuries but I also ripped the ligament in my left wrist. I have just had my third surgery on it including it being the second surgery where they had to take bone out of my leg to use for bone graphing in my wrist. I will never be able to bend my wrist again and not sure how well I will be able to use my hand. The judge has ordered that the city remain in the lawsuit as they were trying to have themselves dismissed as it is extremely hard to sue the city. So far I have about $35,000 in medical bills not including I had to close my business and not to mention what it has put me threw mentally. We will be going to mediation before long and I don't want to turn down a reasonable offer and then have a jury come back with a lower amount. What my question is, is what would be an offer that I should not refuse and if we go to court what would be a reasonable expectation from the jury as to what amount they would award? You see all of these stupid suits where people are awarded millions and when a legit case comes around they seem to not get anything close to that.

This is really the type of question your lawyer should answer. It is difficult to judge a how much a case is 'worth' unless familiar with the details of your case.

I'm not an attorney, this is just a thought or two that might help you and your attorney to come up with a figure somewhere in the realm of reality...
You stated that you had to close your business-can you provide supported information on how much revenue you are losing? How much would it cost you to hire someone to run your business? What is your prognosis,conservatively, of being able to return to conducting your business? If you cannot ever resume and it's impractical to hire someone,how much money do you stand to lose if you have to sell business equipment and assets at fire-sale prices-(under current conditions that could easily be the scenario)?
As you can see I'm using the "reasonable (wo)man" philosophy here, I would think that using supportable information of what financial loss you have already experienced,and may continue to experience,along with medical bills, etc would give you a starting point. As for pain and suffering, or reduced earning power due to your injury, that your attorney might have a better feel for.

I agree that this should be discussed with your lawyer. I'm not a lawyer, but I've heard from personal injury attorney's that the price tag goes up dramatically if you've sustained a perminant injury.
