wrongful death-neglegence?

What is the name of your state? kansas, my question is, in june 2001 my 19 yr old son was riding his 4-wheeler at 11:30 p.m, on a dirt road down the road from us. my son had been drinking, he struck the back of a explorer that was parked on this road with no headlights on. the above driver fled the scene of accident, turned himself in next day, illegal immigrant and no drivers license, do i have any type of case in your opinion? thanks! newt
