Louisiana. Leaving the parking lot of a local sports bar a woman ran up to my car saying I had hit her car. I knew I didn't hit(and I have 2 witnesses that were in my car with me) her car but waited for the police to show up anyway. The police took all the statements and no body had seen me hit the car. The police took a picture of her car but not of mine, got my insurance information and told me I would be summoned to court. I did not get a ticket.
Is there anyway I can get a copy of the statements and police report, or the pictures before going to court?
Do I have to hire a lawyer?
If I loose do I have to pay court costs?
Is this even worth the effort of trying to fight it?

My response:

Yes, it's worth it - - if it's Small Claims court. If her damages exceed your insurance deductible, then turn the matter over to your own insurance company, and let them deal with the matter.

Pay for a copy of the Collision Report and picture. That way, you'll know what her story was at the time of the incident. You'll also know whether she claims to have witnessed you strike her vehicle, or if she has other witnesses.

Subpoena your friends, that were with you, to court. Remember, when the judge asks, you only "had two beers."
