Is your attorney allowed to be openly rude to you?

I was involved in a car accident in Newport Beach at about May 29th this year. Was rear-ended by a drunk driver. The damage: car was caved in through the passenger seats. The driver: DUI at the time, also had her license revoked for previous DUIs (basically was unlicensed).

Well, since I don't have full coverage on my vehicle (just the legal minimum), I sought help from an attorney from the area using attorneysearch.com. He took on the case in early June.

Since then he has: 1). Negotiated a final settlement offer that would not cover our medical bills after his fees and 2). Neglected to file the SR-1 form to the DMV, thus getting my license revoked for 2 weeks. My job requires that I have a license, so I was out of work for those two weeks. He argues that he did file the form, cannot be held responsible for the DMV's actions, and that I should have appeared at some hearing. I was only notified by the DMV that my license was revoked; I had to do the research myself to figure out why. At this point, he has openly laughed at me for holding him responsible for the temporary loss of my job. I feel insulted.

My questions: 1). Is this fair practice? I honestly feel pretty screwed for having hired this guy. It may be important to note that he keeps pushing for litigation, which to my knowledge increases attorney fees regardless of how much we get in return. I don't trust him.

2). How do I get rid of him? He claims that he still has rights to his lien (1/3 of the settlement offer he reached), regardless of how little he actually did during these months. I have another attorney who may take the case if he drops his lien.

I'm at my wits end and don't know what else to do. Please help.

You're driving in California with "State Minimum Insurance"? Yeah, I'd be laughing at you too! Also, you're damn lucky you found ANYONE to take your case. I would have showed you the door, and said "Thanks for dropping by".

Don't bother changing attorneys - - it's not worth it to any other attorney. Hell, it was barely worth it at all! Lick your wounds, and get some thicker skin - - along with a new auto policy giving you coverage of at LEAST 100/300/50. Anything less (if you're at fault) is financial suicide.

God you are such a dick. Thank heavens you aren't this person's lawyer then they would have two screwed up people to have had to deal with. I hate to think what kind of law you do practice because you never give advice just your stupid uneducated opinion. But then what can one expect from a lonely, pathetic creature as yourself. More "shortcomings" than substance.
