Account Closed check

My wife and I own a home in which we have rented out to a person that wanted to purchase it. He asked if he could lease to buy we agreed we our attorney draw up the lease signed it and collected the $250 non-refundable down payment. He moved in on Saturday November 6.

He was then suppose to pay us $2750 for the first month and security depoist this did not happen until Niveber 27. He gave me 2 checks 1 for the depoist and first month $2750 and 1 for $1250 for the second month. I depoisted the checks on 12/1 on 12/7 our bank called and told us the checks had been returned "account closed".

The tennant is now advised us that he is getting a loan to pay us off the depoist and down payment and was suppose to contact me on Friday 12/10 with the amount he could send immediatly and verify the remainder will be sent on Monday 12/13.

What options do we have if the tennant does not come up with the funds on Monday?

First thing I'd do is start FE&D right away. Give him a 3 day notice, then on that 4th day, file the eviction. Hes playing games, hes not trying to pay. Be sure to include all costs incurred in the eviction case, noting that he paid with an "account closed" check. This is a whole different animal from an NSF check. The check in of itself shows criminal intent. Take the case to the prosecutor as well.
