Acquisition co. trying to collect on old bankruptcy debt


What is the name of your state? Georgia Is it legal for one of these companies who purchase portolios of bad debt, send letters to the names of the portfolio without first checking public bankruptcy records. I have received such a letter even though it was discharged through bankruptcy in 1987. I know I can send them a letter stating the case no.etc. but can I use some intimidating wording of my own, and be on solid legal grounds.

On a debt that old, they didn't check anything. I'd say send a letter saying the account in question is timebarred and if it weren't, the account was included in a bk filing and they are just really SOL. Tell them to never contact you about this matter again and, send the letter CRRR.
BTW, was the CA Camco?

Oh yea! They're a topic of conversation on several consumer boards. Unfortunately, much of the language used will violate this site's TOS! Several lawyers are filing suit against them for this pratice. Here is an email from a very well known consumer lawyer you may wish to contact.

We have filed class actions against CAMCO on behalf of residents of TX, MD, CA and IL. The basic allegation is that they represent that people whose debts are beyond the statute of limitations will be held legally responsible for them and that they will update the credit reports of persons whose debts are more than 7 years old. If persons from those or other states want to file similar claims, let us know.

Camco was just barred from doing business in my state for illegal collection practices.

Excellent the hear WA stopped CAMCO in its filthy tracks !! I hope other states will follow their lead. With enough class-action suits, perhaps it will !
