Advice Please


A few weeks ago you gave me some advice about a legal problem, you told me to file a cross compliant, after a compliant has been filed about me concerning being a co signer on a car loan that my ex wife was given responceability for in our divorce decree. My question is what is a cross compliant and will this help me get indeminity, from having to pay this bill.

Dear wembury,

A cross-complaint could best be described as a lawsuit within a lawsuit. You are complaining that you were injured as a result of the same transaction that is the subject of the litigation. While the creditor may get a judgment against you still, you would have a judgment of your own that you could enforce against your ex-wife's assets and that would provide you with "indemnity."

You might also want to consult with the attorney who handled your divorce. You can have the court issue an Order to Show Cause, RE: Contempt of Court for her failing to pay the car loan as specified in the divorce decree and the court will convert the money you are owed into a judgment that you may begin enforcing immediately.
