can a credit card company sue after a bad debt write off? how long does it usually take for them to start the procedure and how long does it take befoer actually going to court?I had problems with all9 of my credit card companies but found that capital one is the only one not willing to help.one site said MBNA but they were quite cooperative with us. they forgave a percentage and are taking a monthly amount for one year to pay the rest. if brought to court, will they take into account all other bills we are trying to pay such as mortgage, electric, phone, insurance, credit card settlement amounts, food and cloths for three small children?

Yes, they can sue. Whether they will or how long before they sue-who knows. It all depends on what they believe they can recover in a reasonable period of time.
Unless state law says otherwise, the judge can't take into account the totality of your situation. They'll just enforce the contract.
The only advice I can give is keep in contact and see if they'll work something out. If you get sued, I'd get a lawyer quickly and see about a chapter 7 or 13 bk filing before I'd let them ganrnish my wages or prehaps get a lein against my home or, get a judgeemnt that'll accure interest for decades.
