Asset and 16 year old debt FL/NY


What is the name of your state?What is the name of your state?What is the name of your state? now FL then NY

I just got a phone call from this Asset Acceptance company today and out of the blue they tell me they've purchased 2 debts of mine with the last contact/payment date of 1989 ... yes 1989! They said the two debts total about $1300 but they would settle for $750. I told them I had lived (15 years ago) at the address (in NY then, FL now) they had for me, but I don't have any records from that period and told them I had no way of knowing that they weren't just scammers making all of this up, she told me they were legit and to look them up on the internet, I did a search and here I am.

I admitted to nothing and clearly will fight it but this is a relitively small amount and it's 16 years old! Why would they even try this? Best as I can tell the SOL is way up in either state. She didn't even know where I lived, I didn't tell her (I'm sure they can find out), but she asked if I was still at that 15 year old address. I followed all the posts and wonderful advice in the thread started by mark40511, but is there something I can do to possibly avoid the attorney option ... or even to help my case before I do ... since this case against me seems shakier (at least smaller and older) than mark40511's.

These debts are clearly outside the statute of limitations. Send a cease and desist letter to AAC. You can find a sample at [url]www.creditinfocenter.com[/url].

There is nothing illegal about AAC contacting you for payment. You will owe this debt forever. All the SOL means is that you have an affirmative defense in the event they sue you.

The cease and desist letter should stop all the phone calls.
