Automobile Reposession


What is the name of your state? Florida

I had cancer, lost my job and got behind on my car payment. They reposessed my car yesterday. I understand why etc. My question is ... they tore up my father's front yard dragging the vehicle out. My purse and many other personal items were in the vehicle and the tow company is telling me that I have to pay 60.00 to get my stuff. Is that legal? My father is extremely upset at the condition of the yard and got a quote of 180.00 to have the area re sodded etc. It looks like a crime scene. What are our rights in this? Thanks

Your father can sue for the damage to his lawn. The $60 access fee sounds normal. You havent' gotten the eye opener yet. In a few months the creditor is going to come after you for the outstanding balance of the car loan after the vehicle is sold.

1) Sorry about your cancer

2) Why didn't you sell the car. Money problems don't just happen overnight. You could've sold the thing and paid it off. If you were upside down on the car, you shouldn't have bought it in the first place.

3) Since when does having cancer make it OK for you not to pay your bills.

4) I Agree, the eyeopener isn't the $60 for your freaking purse, it's the $10,000 they want as the residual for the car.

My advice is to call them and arrange to redeem the vehicle, then sell it.

Don't judge me until you have been in my shoes. The cancer was NOT an excuse not to pay the payment. The payments were supposedly being made by my now ex in return for the help I gave him before the cancer. I didn't even know that my account was in trouble because he hid it from me well. He took the money that he was supposed to be paying on my car and used it for his own back bills with the mind set that he would catch my car up before it got to this point. I had no knowledge of this. And no reason not to trust him. I was staying with my father so that he could help care for my 10 year old son while I recovered and we were all taken by surprise when they reposessed my car. Due to the medical bills, I now cannot pay the past due amount of my car. There is much more however, I do not need judgement from you. I am judging myself enough. I just asked a simple question about the damage to the yard and the stuff in my car. Period. Sorry to sound harsh but until you walk in another person's shoes...please take the time to reconsider your responses.

Don't waste your time explaining anything to someone like wolfie. Sounds like a lowly collector to me. Most people have issues in their lives that happen very suddenly and without notice. Again, Don't waste your time or breath with someone like this. I hope you get better, and I hope your financial situation gets resolved.
