Bank of America Settlement Dispute


Phoenix, AZ

Please need your help! I have been in a settlement agreement with B of A for the past 8 months and I have been faithful in all payments towards the settlement. It was for a large amount, $13,000 (settlement $2,745). I made my final payment August 31st, 2009 in the amount of $603.00 and have deposit slip to prove it. On 9/23/09 I receive a letter from B of A that my settlement is null and void and I will have to pay because they never were able to retrieve the payment from an account that was specifically to be used to pay off the debt. Come to find out that they started adding fees to that account which I was not aware of back in June 2009 which overdrafted the account. B of A collected payments for June and July of 2009 but all of a sudden they could not retrieve the final payment because the account was overdrawn by $350. I spoke to B fo A Card Services along with a Customer Solutions Rep and the Solutions Rep stated that I wouldn't have known about these charges and most likely Card Services would finalize the settlement. Card Services will not settle in fact they stated that they would consider my payments made in May 2009 null and void and then asked me to pay another $823. This is not right! I am just a little guy trying to do the right thing and fighting a giant banking institution which we just bailed out.
