Bank Fraud claim denied

What is the name of your state (only U.S. law)? Florida

My bank just denied a claim I filed with their fraud department for over $2,000. The thieves apparently got my debit card number and pin number and charged the 2 grand which is the reason the bank gave me for denying the claim. (i.e knowing the pin and not guessing) The charges happened in the city that I vacationed to a week after I got back. I had a police report the day after I discovered the fraud that the bank has.

so my questions are:
How did they get all my info, and more importantly how do I get my money back?

Call your bank again and insist that you did not give anyone your PIN (if that is in fact true). Let them know that you believe your card and PIN was compromised by thieves. I would Google "skimming" so you can let the rep know that you know it is possible that you have been defrauded in this manner. Inform the rep that if you do not get a satisfactory resolution you will file a claim with the OCC.

Hope that helps.

Office of the Comptroller of the Currency.

www.occ.treas.gov (I think that is correct. Forgive me if that isn't I am a bit limited on a blackberry).

Research skimming and go to the OCC's website in order to speak confidently when you deal with your bank.

Don't worry about it, it's unrelated to your thread.

ACTUALLY, if you decide to 'report' the banks conduct, that report would have to be filed with the PROPER authority. Not all banks are equal. Some are state chartered and you would report that to your STATE banking commission. Some are federally chartered and you could report those to your state (if you want) AND to the federal regulators (Board of Governors at the Federal Reserve) . If a federal institution.... also report them to the FTC (Federal Trade Commission).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Thanks all for the advice, the bank reopened the case when I told them about "skimming", notifying the OCC, FTC, and FL's state banking agency.

You are correct JetX, I made an assumption as to the authority that would govern his financial institution. Thank you for giving the OP the right info.

OP, I am glad to hear that the bank has reopend your fraud claim. Hope things go well for you.
