Bank held my check for 2 months?


What is the name of your state (only U.S. law)? Ohio


My bank held a check I wrote on August 18,2009 before debiting my account. The problem is that I have used the account a lot since then and apparently I now do not have the funds to cover the check. I have received a notice of insufficient funds from the bank. Is it legal for them to with hold debiting my account for the check this long? It really seems like they just waited until they knew I didn't have the funds to cover the check at the moment although I would hope that wouldn't be the case...

"Apparently", that's your problem. Did not not check your balance online periodically or balance your checkbook when the statement came in? You should have had the money or stopped payment on the check. I doubt very seriously it was intentional. Probably the check got lost internally and they just found it. Doesn't matter though.

The bank has so much time on their hands, and they are truly out to get you. They held that check until the moment they knew that you didn't have the money...in fact they checked your account 10 times a day until that very opportune moment

Oh puhlease... had you used a check register and properly added and subtracted your transactions, that check could have been outstanding for months, and it still would have cleared.

You have no one to blame but yourself.
