Is there a time limit a bank has to fix a misplaced payment? The bank where we have our auto loan through has misplaced a payment we made a year ago. We have sent in over a dozen faxes of the cancelled check (front & back) to them. And here we are a year later and still it has not been credited. Is there anything we can do? Thank you

What do they say is the problem? Go in and demand to see the branch manager. Show them the cancelled check and the faxes and ask their office to fix it.

I wish we could go and see a branch manager. The bank is in Ohio. They are always losing the fax or the research dept never comes back with a response. They have even gone as far as to blame my bank for it. We dont know what the hold up is. We have been told once that it is because no one is working the problem. That they rather call us and bug us until we make the payment. But we refuse to pay something we have already paid and have the proof that we have paid. We have sent what they told us to send.

Well, this is a pain.
May I suggest working higher up the food chain. Call the branch manager and get them involved. Also, I'd call the Attroney General in Ohio and ask for their consumer protection office and also call the State of Ohio Bank Examiners office. I'll bet if you get some outside agencies making inquiries, you'll get some action.
