what is the name of your state? nc i co-signed for my ex-husband to get a car in 1995 . the car was repossesed in 1996. The corp. (gmac) sold the car and, now the corperation is sueing me for the money owed. is there a statute of limitation on this kind of thing? i was served with a notice of right to have exemptions designated november 2002. i have three kids and my present husband is unemployed. i filled out the papers myself and wrote a letter explaining that i don't own anything but my household goods. did i do the right thing? is there anything else i should do?

Assuming that NC laws apply, the SOL for a written contract is 3 years.

So, if the 'last action' (payment or breach) was more than 3 years ago (as your post implies), then the debt would be unenforcable. I would suggest you contact the 'corporation' and ask them to provide you with a 'validation' of the debt, to include a full accounting. Then, if their dates agree with yours, you can simply advise the court (by filing) tha the SOL clock has 'tolled' on the debt.
