Question

Being Sued by unknown credit


What is the name of your state? GA

I rec'd a summons from a creditor filing suit against me that I never had an account with. I have 10 days to dispute this petition. I'm not sure how to go about it nor am I sure where to reference court cases to back up my appeal. If your can help please advise. Thank you

First of all, send a CRRR letter to whomever filed suit demanding they validate the debt as per your rights under the FDCPA. Then, respond to the suit by saying you have never heard of this creditor and have demanded that they validate the debt.

Warning though. Debts are rountinely bought and sold. If you have some chargeoffs, it is very likely the orginal creditor sold or assigned them to another party so, be very careful in claiming not your debt.

I need to know the proper forms to use to answer the notice/ summons with the court. Can I just call the court or go into the court or write the court to ensure they understand I'm not the person.

Isn't there some place on the summons to respond? If you have any questions, call the court clerk's office. For sure, don't give them a win by default.

I'm sending both the court and the creditor a certified letter tomorrow so I can meet my date that way I can record that an answer was sent even if the form I'm using isn't correct. I'm not an attorny so they can't expect me to know the corrt protocal
