Being sued, what should I do?


What is the name of your state? ca
I'm being sued by a collection agency for a past credit card debt, which is $2,000. I am currently unemployed and going to school, can they still sue me? What are my opitions, please help me!!

Yes, they can still sue you, it'll just be harder for them to collect from you with no income. The problem is, if you don't go to court, they will win a default judgment, which you don't really want. They can't get your wages now, but they can and will attach to any future wages you may have thru garnishment.. if your state allows it. Your best bet is still to go to court, they may offer you a payment plan or settlement.

Question.. how old is this debt ?? You say its old.. is it more than 4 years old ? If you haven't paid it in 4+ years, the SOL may have run out. If it has, then you could have the suit thrown out based on the expiration of the SOL, but you'll have to look up when it was last paid. Just a thought....
