Bill Collector - Harrassment


What is the name of your state? CALIFORNIA

Last week I received 3 missed calls on my cell phone with a 904 area code phone number (found out it is a collection agency in Florida). The caller did leave messages. First one was "tick, tick, tick", second was "i see you don't answer your phone, will have to find other ways to find you", and third was "nice going you just made it worse for yourself, now comes the fun part". These calls were on Friday and I have not attempted to return them. Today at work, I was in training all day. Receptionist paged me this evening to tell me this "Mr. Smith" keeps calling and harrassing her and my manager saying that they are lying about my whereabouts, does my company have problems with the phone system, that they are lying under oath to him (which I think is really stupid), they are lying under a tape recorded conversation with him, and that he wants the number of the president of the company. So I called into my voicemail for any messages and there was only one from this same caller, "funny everyone else answers their calls, or you just don't like to pick up the phone - guess which one i think it is" and he hangs up. What can I do? I plan on being in the office tomorrow and will try to call the same number to see if I can find him - but I would much rather speak to a supervisor.

Don't talk on the phone with them. Send a letter CRRR saying it is inconvenient for you to receive phone calls and all communication must be by mail.

You'll never get a 'real' supervisor, he'll hand the phone to his croney sitting next to him and they'll play more stupid games with you.

Read the Fair Debt Collections Practices Act (FDCPA) and learn your rights and a collectors restrictions. If you don't want these calls at work, tell them your employer doesn't allow it and they must NOT call you there again. Get a company name and a mailing address, then you can mail a cease and desist letter to them stating the same thing - you can't take calls at work and calling your cell phone is also a violation.

Thank you for the link. I noticed also they are not to misrepresent themselves. On the fourth call today to the office, the receptionist told me he said he was D.A. Hopkins. She said she feels harrassed as well and is now nervous on answering any phone calls, he drills her on the phone and everytime she tries to transfer the call to my supervisor he continues to interrupt her and degrade her for being a liar. This is really out of control.

As soon as you find out who this loser works for make sure you file a complaint with the FTC and your state's AG.

Tell her to just disconnect this loser, he is breaking the law and there is NO reason for her to have to put up with that kind of crap.

Representing himself as "DA" is a definite violation of the FDCPA, along with all his other verbal abuse and harrassment.
