My Uncle is on life support. It is only a matter of time (days). He owes $27,000 on a 1996 4x4 Dodge Dakota Truck (refinanced and wrecked twice) and a personal loan of $4,000. He owns a 20year old trailer and has no assets, little furniture (barely nothing). He does have a $10,000 life insurance policy. He has no wife or children. My mother (his siter) is the executor of his estate. My uncle has nothing. My mother is now worried about how his bills get paid. She did not co-sign for any of these bills/loans. Is she responsible for his $31,000 debt or do these bills get paid by the state? Please reply soon.

My response:

First, and foremost, your Mom IS NOT responsible for her brother's debts. Her brother "Estate" is responsible for such debts, after burial expenses.

In order to keep what little there is safe; e.g., the $10,000.00, then your Mom needs to, immediately upon his death, file for Probate and open an Estate and obtain the appropriate orders from the court.

Your Mom needs to see an attorney TODAY in order to make these, and other arrangements, for the eventuality of his death - - otherwise, the pressure might be too great for her to deal with if she waits.
