boa credit card/debiting checking account


What is the name of your state? New Hampshire

I have a bank of America business credit card that has been in arears for a few months.
i also have a bank of america personal checking account in good standing. a representative for the credit card called my home two days ago twice once leaving a very pleasant message saying how they wanted to work it out and had some special programs that i qualified for to help me and that i needed to call them.on the second phone call the same representative spoke with my girlfriend and asked for her authorization to automatically debit money from my personal checking to my credit card saying he already had my checking info on file as that was the method i used to make payments to the in the past.my girlfriend replied she was not authorized to give permission for any transaction whatsoever. the very next day my personal checking account had a debit of $740.70 which caused many bounces and other fees. i called the credit card dept of bank of america and was told they can do this.Is that right?????

A. Yes. It is called the "right of offset". You granted permission in the fine print of the deposit contract agreement.
