Business Robbed Of Check, Responsible For Fees?


What is the name of your state?What is the name of your state? California

I wrote a check to a business and they were robbed. Is the business responsible for the fee charged to me to stop payment on my check?

I don't know if there is a "law" but as a businessperson and former banker, my thought would be that if they called you and told you to stop pay the check, then they should cover the expense of the stop pay. If you just decided to stop pay yourself, that would be on your nickel.

There is no law that says the business must cover the fee. Therefore, I'd like to hear how the OP plans on "making" the business pay for the stop payment either way.

I just don't see the business agreeing to do this. Not only that, but the thief now has the OP's check in their hands which means they have their name, the name of their bank, their ABA number, and their account number. They have all the information they need to empty out the account. What the OP should be doing is closing out that account and opening a new one.

His/her bank will be recommending the same thing (if they're any good).

I appreciate the input. I wrote a check to a labor union. I didn't find out about the check being stolen until I got another bill one month later. I called the union office and they suggested stopping payment. I immediately stopped payment and canceled the account.
