CA breaking law?


What is the name of your state? Tx
Got a call from a CA this past week telling me all about the "judgement" against me. Yep, thing is there's never been a judgement. They claimed to be "faxing" the complaint against me to the state of Tx on April 21. Then they called back and wanted to give me one last chance before sending it the second week of May (next week). I've looked at Fed. and Tx Statutes and I know it's wrong to claim judgement against someone unless one has been issued in a court of law. Should I do something about that or leave it be? They called with this message 1 day before they got my validation letter, and left it on a message on my home phone call notes (which I saved). I'm planning on waiting for the validation to come and praying a summons never does!! Any suggestions? (and I finally realized I need to stay off of the phone, so no calls-promise!)

******on a side note, I looked up my credit reports on privacyguard.com (neat site, cheap way to check credit and inquiries, etc.) and as of yesterday there were no judgements against me. I'm adding this because that's the only way I "know" there are no judgements. Silly as it sounds, I have two very messy roomies and I've had several pieces of mail lost over three years. I've been concerned that a summons has been delivered or a card left and it never got to me and perhaps a default judgement was entered. However, nothing is showing up on that site. Is there a better way to find if a judgement is actually on me? Sorry for the long-windedness but I'm feeling overwhelmed and unsure about my next steps. I'd appreciate any help

FAX a complaint to the State of TX ?? What a CROCK !!!!

Yes, there is a fool-proof way to find out if there is a judgment against you - call the courthouse and ASK. If there's been a suit filed, the court clerk will be able to tell you. Then you can ask for a copy of the case file to get all the details.

Yeah, pretty fishy huh? I did a check on a website for judgements and came up with nada. Which courts do I call? There are many small claims, civil courts, district and county courts. I may sound stupid but I just want to cover all of my bases. I live in the city of Mesquite, which is in Dallas County. So just Dallas county courts, etc? Like I said in my first post, sounds pretty silly to me. I'm betting not only are there not any current judgements but they really aren't going to pursue this legally. Other than checking for judgements, anything else I should do?

If you've always lived in Dallas county, then that would be where a judgment would most likely be IF it exists. If you've lived in other counties, try those then too.

How old is this debt, when did you last pay the original creditor ?

I've lived in Dallas Cty. for the past 7 years, and I last paid the original creditor about a year ago. So like you said, if a judgement exists it will be in Dallas Cty.
