Hello, I am from Tennesse and I have recently encountered a big problem with a creditor. I have a debt with discover that has been sent to a collection agency. This debt has been delinquent and I have not made any recent payments on it. It's been charged off. It's been over 6 years. Well, I just recently talked with a creditor and he talked me into letting him take out Electronic Transfers from my account for $500.00 dollsrs for three months. I told him that I could only give him $250.00, but he said NO! He had to have the whole $500.00 dollars in order to clear the debt. The deal was to pay 15,000.00 in three months instead of 28,000.00 to clear my debt. I set it up for him to take the money out my accout, but I had to stop payment on the check because I had some unexpected emergencies come up. He called and asked why I stopped payment and I told him why. He said he was going to send the next check through that was due on the next month,on the next day. So, I was forced to stop payments on the other checks. He called my mother, amd told her that he was going to have me arrested. The next day the Sherriff's department called her and wanted to know where I was. I am 30 years old and live 250 miles away from my mother. The sheriffs dept. told her that she needed to talk to the creditor in order for them to stop the warrant for my arrest. She called, begged and pleaded for him to stop the warrant. He told her that if she paid him $500.00 dollars by monday then he would stop the warrant. I kindda looked over the FDCPA, but can I be arrested for the checks that I cancelled? He also changed the dates on the checks that I told him he could take the money out on. PLEASE HELP!!!
