can i go after a payment owed after bankruptcy?


A contractor that i do work for is filing for bankruptcy but he is still doing business secretly and i know the telephone number and the people he is doing the work for. Can i win in court to get my money from this contractor. He owes me roughly 4000 dollars. and many peple are in lawsuits already with him. What should i do he has asked me to pay it off by working with him and to keep working with him. Thanks for any help.

Sounds to me that he is in the beginning stages of bankruptcy and hasn't been discharged (finalized) . Here is my advice: when an Creditors Meeting is scheduled you go to it armed with evidence of him working and being able to pay his debt.

If you are listed in his list of creditors then you must cease all collection efforts (once he files, hopefully you would get a notice of such action from the court). The only way you would be able to get funds is to go the creditors meeting and also make known to the Trustee of any fraud going on by the debtor.

Do you know what chapter he is filing? 7, 13, ?
