Well he didn't mention anything about fraudulently obtaining the account. Actually he didn't say much of anything so, yep you are right.
And you can be arrested for almost anything. Whether or not charges are filed or how long you are detained are completely different stories.

The law does not provide for an arrest as a way for a creditor to deal with someone no paying their credit card debt. However, a number of legal process steps that could happen can result in having to answer certain things to the courts as ordered by the judge. A failure to answer (or perhaps explain why no answer is available) to the court can result in an arrest, by court order. Contempt of court can also result in jail time.

Being arrested is still possible as a result of errors, misunderstanding, or illegal actions by others. Depending on the circumstances, there may be cause for compensation in these cases.
