Can they do this!?!?

i had taken a loan out against my car through a local bank a few years back. a couple of months ago i fell behind in payments. i did not put in a relocation notice with the bank so they could not reach me personally, however they had my mother's current information. a representitive from the bank contacted my mother and she contacted me. i had spoke with them and my loan officer was out for a week so i told them i would call back and speak with her directly. in the mean time another rep of the bank had called my apartment complex, my brother, my place of employment, and my mother's work and spoke with her coworker. they told them all about the situation, that i was behind on payment and in threat of repossession. when their attempt to get information from those persons failed they then went to my grandmothers house and explained it all to her, and even lied and said that i would be in trouble for fraud if they didn't talk to me ASAP. which is completely out of line, my grandmother broke down and was severely upset. basically i am furious that they had my whole family stressed and concerned, and have embarrassed me to people i don't even know. is it legal for them to give out that much personal information, and if not what can i do about it? thank you

Unfortunately, if you're dealing directly with the original creditor, they are NOT bound by the FDCPA as 3rd party collectors are. OC's can and do get away with murder. However, there is still the matter of privacy and I'd say these people are crossing the line.

You obviously need to deal with this and get the payments made, but I'd be camping on some bank VP's desk and making a BIG stink at their breach of privacy - not to mention the distress they caused an elderly woman !!

Read your contract. It will state that they can and will contact anyone listed on your application as a reference and can and will disclose information about the loan. You started the problem so why complain? You agreed to everything they did to get the loan.
