Capital One charged off my accounts!


What is the name of your state? FL

I called Capital One a couple of weeks ago to activate a new card...let me preface by saying that I had just made payments to the accounts...they were all up to date...they had even raised my credit limits! When I call to activate, the CS rep tells me that my accounts were charged off because I had filed for bankruptcy (a Chapter 13)...I had filed for bankruptcy in mid-October, but never filed any papers or planned to include Capital One in the bankruptcy at all (the balances are very small)...my question is: can they just arbitrarily charge off my accounts without a judge's order? I didn't even file a chapter 7! Help!

They sure can close the account and charge it off.
You better amend your filing and include them as a creditor. You are supposed to list ALL creditors.
Once they know about your bk, they can't send you statements because you're covered by an automatic stay-this would be considered collection activity.
