Capitol One has a hold on my bank acc.

I live in Michigan; my wife had a credit card a few years ago, with a $400 limit and has forgotten about it. Now they have a hold on our bank account until she pays a total of $1,500. Both our names are on the account and my paycheck are directly deposit into. All this happen with out any notice or prier contact to resolve this.
My question: Was it legal for them to do this?
What are my options?
Now with this un-inspected hold, we cannot provide food to our four children. We only had $300 dollars in the bank for utility bills and food, but they have token that and now I will have checks that will bounce.
She tried to contact the lawyers (capitol One) and they made my wife cry!
Please help!

Thank you,
Rick H.

It sounds as if they have gotten a judgment against your wife. If they did, they can seize her/joint bank accounts.

Did you move and not notify the cc?

You can try to petition the courts about not being served. Being the weekend, you will have to wait until next week to do anything.

Pretty simple.... pay the judgment.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Call the courthouse and ask the court clerk for a copy of the judgment case file. That will give you details of the lawsuit that has obviously been won against your wife.

You DO have the right to challenge the bank levy, but do it soon.

As for the jerks making your wife cry, even when collecting on a judgment they must abide by the FDCPA - verbal abuse is NOT ALLOWED !
