case of mistaken identity

Thank you for the reply, Ladynred! I did not send anything to the CRA's, I called them and spoke to someone over the phone. When I disputed the items, I indeed said "not mine" to each item.
I attempted to call the lawyer who is involved with garnishing my wages, but got nowhere. However, at the time, I did not ask for the SS# that HE has on his file. I will call him immediately and ask. You stated that this type of situation is a serious problem with the CRA's getting everything screwed up. I would like to know if there is any legal action I can take or if there is an agency I can contact to inform them of these ongoing problems!! I would think others who are or were in a similar, if not the same situation as mine, would have written to an agency who oversees the credit bureaus. Is it worth the time to write?
Oh, by the way, I took a look at my Experian and Transunion Reports, and they showed no problems. Why is only one credit bureau showing a problem and not the others?

Not all creditors report to all 3 CRA's.. so Equifax has all the data on this one .. and they're a royal pain. You have to hold their feet to the fire and the letter of the FCRA to get results. Do everything in writing and if they stonewall you, you start quoting relevant sections of the FCRA and threaten to sue them. They've been sued before and lost.

I'd also write this attorney with the garnishment a strong letter indicating they are garnishing the wrong person and demand that he produce whatever proof he had that he used to get the writ of garnishment in the first place. Call the courthouse and get that case file if you can, you may be able to attack this wrongful writ from that end too so you can stop the nonsense and get your money back.
