CC Summons Received- What Now?


What is the name of your state?New York

I Just received a summons to appear in court in regards to a credit card that I had years ago. I don't know exactly when I had this card. The summons says I have 30 days to respond I just got it in the mail August 9th yet the summons is dated June 28th. I don't know exactly what do to next.

Will a lawyer try to sue even if the SOL is up?

How should I proceed?Help!

Your response period begins to run on the date you receive the summons.

The first thing to do is to determine if the debt is out of statute. Which means you need to know when you last made a regular payment on the account.

Get a copy of your credit report and look at the entry for the original creditor. What does it say for date of last activity? That would be a good place to start figuring out the SOL.

If you ignore the summons, the creditor will be awarded a default judgment. Then comes wage garnishments and a levy on your bank account.
