Question

Charge Off Accounts


I had a credit card account that was charged off as of October 26th 1995 and I have had no contact from that company or any collector's since that time. I have now received a summons from them stating that they have put a judgement against me and this is the first letter I have received in 6 years. Is there a statute of limitations against them filing and or a limit on no contact and then filing. I would like to know what I can do from here. I live in Tennessee however I believe the summons says State of Michigan.

I would read the post further down the board titled "Charged Off Account Threatening Lawsuit". It sounds similar to your situation.

According to the info I found at [url]www.creditwrench.com[/url] the Statute of Limitations in Michigan (for credit card debt) is 6 years. My guess is their time is up!

Charge Off


How can I get more information on the statute of limitations in Michigan. I have looked into the link that was left on my posting it would not connect. Continued to give me an error message. I'm going to court very soon and I don't believe I can afford representation.

I don't suggest you refer people to the creditwrench website, or take any advice from it - you will be seriously misled. Mr. Bauer was a short-time contributer to this forum who had to be removed because he was disruptive and the information he was giving was patently false.

Because he was so disruptive, we looked into him. It turns out that he followed his own advice on how to manipulate creditors and it ended with his house being forclosed upon. He was thrown out of his home by the creditors he claims to manipulate and evade so successfully. He apparently experimented on his family as well, because there is a whole slough of collection judgments against various members of the Bauer family in his area.

His website is just a money making scam. He has others (mostly MLM programs where he sells everything from diet pills to cigarettes). Stay away.
