| We would be able to help you with the Statute of Limitations in your state, but you failed to tell us what state you are located in. DO YOU SEE THE BIG RED LETTERS ON *EVERY* PAGE OF THIS FORUM??? Also, let us know if the collection agency has filed a lawsuit against you yet, and if so, have they obtained a judgment from the court? JASON@LEGISLATOR.COM |

| my state is south carolina. my former wife and I have been divorced for 4 years. she let the car go back in 1995. Since that time, we have both re-married, and she and her new husband have filed for bankruptcy. i figure that is why GMAC is threatening me. a judgment was filed and they have sent some sort of document to the local sherriff's office stating that personal items can be seized and auctioned. what can they take? isn't the statute of limitations 7 years? if so, the 7 years will be up in march of this year. if items are not in my name, or are still owed on, can they be seized? |
