Check Fraud


What is the name of your state? New Jersey

I took out a payday loan and now they are try to charge me with Banking violations and check fraud, None of the information that I provide was incorrect. They are pursing these charges for non payment, can they charge me with this charges. My account was closed by the bank due to NSF's.

I suspect that they are trying to intimidate you. Only the DA can bring criminal charges for bank fraud. They can file a police report but I don't think they would get very far with it unless they have pretty solid proof.

Check Fraud


I am from New Jersey, the company that has my account said that they were going to pursue with these charges, keep calling my job and saying that if a payment is not made by a certain time that they are going to submit my name to the State database for these charges to come against me. Can they do that? I work for the State of NJ and I can not have anything on my background....

They can submit your name to the Pope if they want -- but only the local DA can bring criminal charges.

Call the local District Attorney and ask if they can do what they are threatening. I am not aware of any state that maintains a database of people who do not pay payday loan companies. The failure to pay is purely a civil matter unless there is fraud. Again, the DA will decide on the fraud question.

I am sure you are not the first state employee who has had this problem.
