    checking acct raided by bank

    What is the name of your state (only U.S. law)? Florida. Recently I stopped making payments on my CC from my credit union. They asserted their right to set off and took a large sum of money from a joint account I had with my wife. However, all the money in this joint account was my wifes that she had earned from her job. This is easily proved by the statements which show direct deposit. My question is does she have any chance of winning a small claims court case against the credit union to get her money back. We are not talking a writ here but a set off. Thanks Creditfool

    Simple answer... no. It was a joint account and they had every right to a 'set off'.

    However, all is not lost. you might suggest that your wife file a lawsuit against YOU to recover her funds that were taken to cover YOUR debt. That is the only way that she has a chance to recover HER money.
    There are at least 17 lawsuits (!!) filed in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

    Why has he spent over $1.7M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

    Does anyone have any real knowledge about the law in florida on this site, or is it only a frustrated comedians 12 step organization.

    Let me explain the fool that I am. I will be filing bankruptcy for the 4th time in a couple of months. This particular time I will beat the xxxx for over 50,000. That makes for a grand total of over 120,000 over the years. And the great thing about it is that about 6 months after they will start giving me credit again. And guess what dogbreath, your interest will go up !! You know, I kinda like you guys, thanks for helping to pay my bills. and keep making those timely payments!!
