| I live in New York City and and entered into a payment arrangement with the law firm who is representing the creditor. I was surprised when I received paperwork from the law firm which included a "Summons & Complaint" indicating that I have 20 days to appear and respond (a copy of the Stipulation of Agreement was also included, but this I understand). I have entered into this agreement in mid December, and have already made the initial down payment (Dec. 22) and 1st installment (Jan. 3rd). I don't understand why this is occuring and why I need to appear in Civil Court. Do I? |

| I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship. Do you have proof of the written agreement? Signed by them? If so, state that in your answer -- they have a right to breach the agreement, but with consequences. See if there is any in the agreement you signed. Might want to try http://www.attorneypages.com to see if you can get a lawyer to give you a free consultation. |
